WHAT ABOUT PRODUCT LIABILITY?
|
|
|
On October 1, 1996, President Clinton signed the Bill Emerson Good Samaritan Food Donation Act. This Federal statute supercedes all the fifty states' various forms of "Good Samaritan"
laws and provides consistent protection.
This Act encourages the donation of food to those in need through non-profit organizations, such as food banks. These statutes limit the liability of a person or organization in connection with the donation and ultimate distribution of food to needy individuals through a nonprofit organization...when donated in good faith.

IS THERE AN ADVANTAGE TO DONATING PRODUCT?
|
|
- It feels great for everyone. Businesses have some particular incentives, too.
- There is a tax advantage. Since June 2002, through the CARE Act, that tax incentive has been extended to farmers, restaurants, and small businesses, as well as food
corporations. Generally, the donor business can deduct the basic cost of the product (production, transportation, etc.) plus one-half the usual product.
Tax advisors can help here.
- Donor companies often find that donating is good PR internally and in the community.
- Often a donation is made when the product is no longer available for usual sale--perhaps there is a slight change of formula or packaging, or the product is "short-dated".
Remembering MANNA means a "problem solved", and we can help avoid further storage costs or disposal costs. Thus, together we make a sensible ecological choice.
